Canada’s Anti-SPAM Legislation (CASL)
Canada’s ANTI-SPAM legislation has been described as the most comprehensive program yet with consideration given to both email SPAM and the unsolicited installation of programs or computer software on computers.
This new law generally prohibits :
- the sending of commercial electronic messages (including email, social network messages and SMS messages) without your explicit consent
- the use of false or misleading representations online in the promotion of products or services
- the collection of personal information through accessing a computer system
- the harvesting of email addresses by the use of computer or programs
Starting on July 1, 2014 all messages sent to you must include :

- a clear identification of the sender (with a valid email address) and
- a clear method to unsubscribe from communications from the sender
I get SPAM email all of the time, how does this new law affect me ?
In the short term it may not. The federal government considers implied consent to exist for a period of 3 years if there is an existing business relationship between the parties or their is an existing CEM (commercial electronic message) relationship between the two parties.
Before the three year grace period expires you MUST explicitly consent to receive emails from a sender in order to receive their communications.
